1. Introduction
These Terms & Conditions ("Terms") govern the use of the pixellab.services website and the engagement of services provided by PixelLab ("we", "us", "our"), including website development, web design, e-commerce development, app development, custom software development, AI development, AI automation, SEO, digital marketing, Google Ads and website maintenance and support. By using this website or engaging PixelLab for a project, you agree to these Terms.
2. Definitions
- "Client", "you" — the individual or business engaging PixelLab's services.
- "Services" — any digital service PixelLab provides, as listed in Section 4.
- "Project" — a specific piece of work agreed between PixelLab and the Client.
- "Deliverables" — the websites, applications, designs, code, content or other outputs produced for a Project.
- "Agreement" — a specific quotation, proposal, invoice or written agreement for a Project, where one exists.
3. Acceptance of Terms
By browsing this website, submitting an enquiry, or engaging PixelLab for a Project, you accept these Terms. If a written quotation, invoice or Agreement for a specific Project contains terms that differ from this page, those project-specific terms may apply to that Project alongside these general Terms.
4. Services
PixelLab provides digital services including, but not limited to:

- Website Maintenance and Support
Not every service is relevant to every Project — the specific scope for your Project is what's agreed between us in writing.
5. Project Scope
Each Project is based on the scope discussed and agreed with the Client — for example, in a quotation, proposal or written communication. Work outside that agreed scope is treated as additional and may require a separate quotation or timeline adjustment before we proceed.
6. Quotes and Pricing
Quotes are based on the information and requirements shared with us at the time. Pricing may need to be revised if requirements change materially after a quote is given. Quotes are valid for a reasonable period unless otherwise stated, after which they may need to be reconfirmed.
7. Payments and Advance Payments
Projects typically require an advance payment before work begins, which secures our time and confirms the Project in our schedule. Remaining payments are due as agreed for the Project — for example, on milestones, on a schedule, or on completion. Work may be paused if agreed payments are not received on time.
8. Milestone Payments
For larger Projects, payment may be split across milestones (such as design approval, development completion, or launch). Each milestone payment relates to the work completed up to that stage and is not contingent on later stages of the Project.
9. Client Responsibilities
To keep a Project on track, the Client agrees to provide timely feedback, approvals, access and information reasonably requested by PixelLab. Delays in providing these may affect the Project timeline and are not the responsibility of PixelLab.
10. Client Content and Materials
The Client is responsible for the accuracy, legality and rights to any content, images, text, logos or other materials they provide for use in the Project. PixelLab is not responsible for reviewing the legal accuracy of Client-supplied content, and the Client confirms they have the right to use any materials they provide to us.
11. Project Timelines
Timelines are estimated based on the agreed scope and assume timely Client input. Timelines may shift due to scope changes, delayed feedback, delayed content, or factors outside PixelLab's control (see Section 31). We'll communicate any expected changes to the timeline as early as possible.
12. Revisions and Change Requests
A reasonable number of revisions within the agreed scope are part of our process. Requests that go beyond the agreed scope, or that are requested after a stage has been approved, are treated as additional work and may be quoted and scheduled separately.
13. Website and Software Development
Website and software Projects are built according to the agreed scope, features and, where applicable, design mockups. Browser, device and third-party compatibility are tested reasonably but cannot be guaranteed indefinitely, as browsers, operating systems and third-party tools continue to change after launch.
14. E-commerce Development
E-commerce Projects depend on the correct setup and ongoing use of the store's payment gateway, product data, tax settings and shipping configuration. PixelLab is not responsible for decisions made by payment processors, marketplaces or shipping providers, or for store performance issues caused by Client-managed product listings or third-party plugins added after handover.
15. AI Development and AI Automation
AI and automation Projects are built around the use cases and data agreed for the Project. We do not guarantee specific AI-generated outputs, accuracy levels, or business outcomes, as these depend on the underlying AI models, the data provided, and how the tool is used after launch. Where a Project uses a third-party AI provider or API, that provider's own terms, availability and limitations also apply.
16. SEO and Digital Marketing
SEO and digital marketing work is carried out using recognised good practice. We do not guarantee specific Google (or other search engine) rankings, traffic levels, leads, sales, revenue or conversions, as these depend on factors outside our control — including search engine algorithms, market competition and platform policies.
17. Google Ads and Advertising Spend
Where we manage advertising campaigns, PixelLab's fees are for our management and strategy work and are separate from advertising spend paid to the platform (such as Google). We do not guarantee specific advertising results, leads, sales, revenue or conversions. Advertising platforms set and enforce their own policies, approval processes and costs, which are outside our control.
18. Third-Party Services
Projects often rely on third-party services and tools — for example, hosting providers, payment gateways, AI providers, plugins, APIs or advertising platforms. These services are outside PixelLab's direct control, and we are not responsible for their availability, pricing changes, policy changes, or outages.
19. Hosting and Domain Services
Where PixelLab assists with hosting or domain setup, ongoing hosting and domain costs are billed by the relevant provider and are separate from PixelLab's service fees. The Client is responsible for renewing and maintaining their own hosting and domain accounts unless a separate maintenance arrangement is agreed.
20. Maintenance and Support
Maintenance and support are provided as agreed for a specific Project or support arrangement — for example, a fixed period after launch, or an ongoing arrangement. Work outside an agreed maintenance scope (such as new features) is treated as a new Project or change request.
21. Intellectual Property
Unless otherwise agreed in writing, ownership of final Deliverables (such as a completed website or app) transfers to the Client once the Project is paid for in full. PixelLab retains the right to showcase completed work in its portfolio, case studies and marketing, unless the Client requests otherwise in writing. Any pre-existing tools, frameworks, libraries or internal code owned by PixelLab and used to build a Project remain PixelLab's property.
22. Source Code and Deliverables
Access to source code and other Deliverables is provided according to what's agreed for the Project. Deliverables that depend on third-party licences (such as paid plugins or themes) are subject to that third party's own licence terms.
23. Confidentiality
Both parties agree to keep confidential information shared during a Project (such as business plans or non-public data) private, and to use it only for the purposes of that Project. This does not apply to information that is already public or independently known.
24. Security
We take reasonable steps to build and maintain secure websites and applications. However, no website, application or system can be guaranteed to be completely free of vulnerabilities, and PixelLab is not responsible for security incidents caused by third-party services, Client-managed credentials, or changes made after handover by the Client or another party.
25. Cancellation and Termination
Either party may request to cancel a Project. Cancellation terms, including what's owed for work completed up to that point, are handled according to our Refund Policy and any project-specific Agreement.
26. Refunds
Refund eligibility depends on the Project stage, work already completed, and the terms agreed for that Project. Custom digital work already completed, and third-party costs already incurred, are generally handled as described in our Refund Policy, which applies alongside these Terms.
27. Service Limitations
Our services are provided on a reasonable-efforts basis using recognised good practice. We do not guarantee uninterrupted or error-free operation of any website, application or integration, particularly where third-party services are involved.
28. Third-Party Platform Availability
Platforms such as Google, app stores, payment gateways, hosting providers and AI services may change their features, pricing, policies or availability at any time. PixelLab is not responsible for the impact of such changes on a Project or Deliverable.
29. Warranties and Disclaimers
Services are provided "as is" and PixelLab makes no warranties, express or implied, beyond what is explicitly agreed in writing for a Project. We do not warrant that any Deliverable will be error-free, uninterrupted, or fit for a purpose not disclosed to us in advance.
30. Limitation of Liability
To the maximum extent permitted by law, PixelLab's total liability for any claim relating to a Project is limited to the amount paid by the Client for that Project. PixelLab is not liable for indirect, incidental or consequential losses, including loss of revenue, data or business opportunity.
31. Force Majeure
Neither party is responsible for delays or failures caused by events reasonably outside their control — such as internet or power outages, natural events, or third-party platform outages — beyond making reasonable efforts to minimise the impact.
32. Dispute Resolution
If a dispute arises, both parties agree to first attempt to resolve it directly and in good faith through written communication before pursuing any other remedy.
33. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
34. Changes to Terms
We may update these Terms from time to time to reflect changes to our services or practices. Material changes will be reflected by updating the "Last Updated" date at the top of this page.
